Welcome to Whittier Village Pools (“WV Pools, Inc.,” “Company,” “we,” “our,” or “us”). By accessing or using our website and services, you agree to the following Terms and Conditions.
If you do not agree, please do not use our website or services.
1. Services
Whittier Village Pools provides residential and commercial pool maintenance and related services within California. All services are subject to availability and may require a written service agreement.
2. Age Requirement
You must be at least 18 years of age to enter into this agreement. By using our services, you represent and warrant that you are at least 18 years old and possess the legal authority to form legally binding contracts.
3. Estimates & Service Agreements
Any quotes or estimates provided through our website, phone, or email are non-binding until confirmed in writing. Ongoing service plans are governed by separate written agreements between the Company and the customer.
4. Payments
Payments are processed through Full Steam and/or Square. We do not store full credit card information on our servers. By submitting payment, you authorize us to charge the provided payment method for agreed services.
Late payments may result in late fees, service suspension, or cancellation of service. There will be a $25.00 fee for all returned checks.
5. Cancellations
Customers may cancel services according to the terms outlined in their service agreement. We reserve the right to terminate services at any time for non-payment, unsafe property conditions, harassment or inappropriate conduct, or violation of service terms.
6. Customer Responsibilities
Customers agree to provide safe and unobstructed access to the pool area on scheduled service days, maintain pets in a secured area during service visits, inform us of known hazards, remove pool covers, solar covers/rings, toys, rafts, and similar items on day of service, and ensure that all gates are operating properly.
We are not responsible for damage caused by unsafe property conditions, undisclosed hazards, locked gates, aggressive pets, or customer failure to provide access. Service technician assumes no responsibility for maintaining fences or gates at customer’s property.
Missed service due to locked gates, unsafe conditions, or failure to provide access will not result in service credits.
7. Weather Policy
During the off-season, service may be postponed due to inclement weather or hazardous conditions. During the swimming season, service will be performed regardless of weather conditions. There are no credits for service visits postponed due to weather.
If you believe a service call was missed for reasons other than weather or access issues, please contact the company within 24 hours and the service call may be rescheduled.
8. Emergency and After-Hours Service
Emergency service requests outside regular business hours (Monday-Friday 9am-5pm, Saturday 9am-4pm) may incur additional fees. Please contact us for emergency service rates and availability.
9. Service Limitations
Services are provided “as is” and “as available.” We do not guarantee specific results or water quality outcomes, as these depend on factors beyond our control including weather conditions, equipment condition, bather load, environmental factors, and customer compliance with maintenance recommendations.
While we strive to maintain optimal pool conditions, we cannot be held responsible for water quality issues arising from malfunctioning or inadequate equipment, extreme weather events, excessive use or contamination, failure to follow recommended maintenance procedures, or conditions existing prior to our service commencement.
10. No Third-Party Financing
Whittier Village Pools does not offer or facilitate third-party financing options. All payments must be made directly to Whittier Village Pools via the payment methods specified in Section 4.
11. Website Use
You agree not to use the website for unlawful purposes, attempt to interfere with website security, submit false or misleading information, or use the website if you are under 18 years of age.
12. Limitation of Liability
To the maximum extent permitted by California law, Whittier Village Pools shall not be liable for indirect, incidental, consequential, or punitive damages arising from use of our services or website.
Our total liability shall not exceed the amount paid for services in the prior 30 days.
13. No Warranties
Services are provided “as is” and “as available.” We make no warranties or guarantees regarding uninterrupted website availability or specific service outcomes.
14. Intellectual Property
All website content, including logos, text, graphics, and other materials, is the property of Whittier Village Pools and may not be used without written permission.
15. Governing Law
These Terms are governed by the laws of the State of California. Any disputes arising from these Terms or our services shall be resolved in the courts of California.
16. Changes to Terms
We may update these Terms at any time. Updates will be posted on this page with a revised effective date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
17. Entire Agreement
These Terms and Conditions, together with any written service agreement, constitute the entire agreement between you and Whittier Village Pools regarding our services.
